You agree to immediately notify iCarBuyer in writing of any unauthorized use of your password or account or any other breach of security and ensure that you exit from your account at the end of each session. iCarBuyer is not liable for any loss or damage arising from your failure to comply with this Agreement.

iCarBuyer provides users with an Internet based, automobile information platform, which includes related services. All information provided on this Site is for informational purposes only. Information displayed through the Site related to any virtual vehicle you may configure, such as dealer cost, factory invoice, market average, or MSRP, either reflects or is based on available data relevant to your virtual vehicle and does not reflect a dealer's price for an actual vehicle consistent with your preferences. Should you decide to configure a vehicle and request information about that vehicle from dealers, then certain dealers may respond to you and contact you. Any information that you may receive from an automobile dealer is provided directly to you by the dealer and is not provided by iCarBuyer. Neither the accuracy of information provided on this Site, nor the availability, quality, or safety of vehicles, is guaranteed or controlled by iCarBuyer, and iCarBuyer assumes no responsibility for the foregoing. You agree that any reliance on the information on this Site is at your own risk. Any discrepancies or mistakes made regarding vehicle availability, condition, pricing, and the like are not the responsibility of iCarBuyer and should be directed to the dealer or third-party vendor. You are encouraged to thoroughly review any documents you are asked to sign at the time of purchase or lease of a vehicle or of other products or services.

By using the Services, you acknowledge and agree that participating dealers may not have a vehicle that exactly matches any virtual vehicle you may configure on the website, in inventory, and certain models or configurations may not be available. The specific dealer will confirm vehicle availability, including available options and colors, from actual inventory. Each dealer sets and controls its own pricing. You may negotiate the purchase price directly with the dealer, and iCarBuyer will not and does not play any role in the resulting negotiation and/or purchase. Any information communicated directly to you by a dealer for a vehicle consistent with the preferences expressed in any virtual vehicle you may configure may change if the actual in-stock vehicle that you choose to buy differs from the configuration of your virtual vehicle.

For the avoidance of doubt, iCarBuyer is solely a research and communications platform. iCarBuyer is not a vehicle seller, dealer, broker or agent for vehicle sellers or dealers, nor a provider of, or broker or agent for, other automobile-related products or services offered by third parties. For clarification, iCarBuyer receives a fee from participating automobile dealerships, and/or third-party service providers, in the connection with the services provided through the Site.

Except for your personal information, any material, information or idea you transmit to or post on this Site by any means (“Your Information”) will be treated as non-proprietary. By transmitting Your Information to iCarBuyer, you are granting iCarBuyer and its affiliated companies permission to use Your Information for any purpose whatsoever, including, but not limited to: (i) developing and marketing products; and (ii) copying, distributing, transmitting, publicly displaying, publicly performing, reproducing, editing, translating and reformatting Your Information, in accordance with our Privacy Policy. By transmitting Your Information you warrant and represent that you own or otherwise control all rights to Your Information.

No compensation will be paid with respect to the use of Your Information. iCarBuyer is under no obligation to use Your Information and may remove Your Information from this Site at any time in iCarBuyer's sole discretion.

Any personal information that forms a part of Your Information will be treated in accordance with our Privacy Policy.

ICARBUYER DOES NOT WARRANT THAT THE SITE AND THE CONTENT ARE FREE FROM ERRORS OR OTHER PROGRAM LIMITATIONS OR THAT THE SITE AND CONTENT WILL BE ACCESSIBLE AND PERFORM IN ACCORDANCE WITH YOUR EXPECTATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM ICARBUYER OR THROUGH OR LINKED FROM THE SITE SHALL CREATE ANY WARRANTY EXPRESS OR IMPLIED. ICARBUYER IS NOT RESPONSIBLE FOR MAKING REPAIRS TO ANY VEHICLE. IF YOU HAVE COMPLAINTS OR CONCERNS ABOUT DEFECTS OR REPAIRS, PLEASE CONTACT THE DEALER, SELLER, OR MANUFACTURER DIRECTLY.

YOU SPECIFICALLY ACKNOWLEDGE THAT ICARBUYER SHALL NOT BE LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF THIRD PARTIES.

THE EXPRESS WARRANTIES IN THIS AGREEMENT ARE IN LIEU OF ALL OTHER WARRANTIES, CONDITIONS, TERMS, REPRESENTATIONS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT. IN NO EVENT SHALL ICARBUYER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, OR ANY VEHICLE REFERENCED ON THE SITE, EVEN IF ICARBUYER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, THE ENTIRE LIABILITY OF ICARBUYER UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO CAD $50.00.

YOU HEREBY IRREVOCABLY WAIVE ANY CLAIM (WHETHER FOR INJURY, ILLNESS, DAMAGE, LIABILITY AND/OR COST) AGAINST THE ICARBUYER ENTITIES ARISING OUT OF YOUR USE OF OR INABILITY TO USE, OR IN CONNECTION WITH, THE SERVICES, INCLUDING ANY INFORMATION AND CONTENT ON THIS SITE OR ANY THIRD-PARTY WEBSITE, PRODUCT, OR SERVICE LINKED TO OR FROM THIS SITE, INCLUDING ANY CONTENT YOU PROVIDE TO THIRD PARTIES (INCLUDING PERSONALLY IDENTIFIABLE INFORMATION).
